By accessing or using Archyl's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. These terms apply to all users of the service, including without limitation users who are browsers, customers, merchants, and contributors of content.

2. Description of Service

Archyl provides an AI-powered architecture documentation platform that enables users to create, visualize, and maintain software architecture documentation using the C4 model. Our services include:

• Interactive C4 model diagram creation and editing
• AI-powered architecture discovery from code repositories
• Architecture Decision Records (ADR) management
• Share & embed diagrams in Confluence, Notion, Miro, and more
• Integration with Git providers (GitHub, GitLab, Bitbucket, etc.)
• Export and documentation generation

3. Account Registration and Security

To access certain features of our services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use Policy

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our services. Prohibited activities include:

• Violating any applicable laws or regulations
• Infringing on intellectual property rights of others
• Uploading malicious code, viruses, or harmful data

• Using the service to send spam or unsolicited communications

The Archyl service, including all content, features, and functionality, is owned by Archyl and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. User Content

You retain ownership of any content you create, upload, or store using our services ('User Content'). By using our services, you grant Archyl a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving our services. You are solely responsible for your User Content and the consequences of posting or publishing it.

7. Payment Terms

Certain features of our services require payment. By subscribing to a paid plan, you agree to pay the applicable fees. All fees are non-refundable unless otherwise stated. We may change our fees upon 30 days' notice. Continued use of the service after a fee change constitutes acceptance of the new fees. Failure to pay may result in suspension or termination of your account.

8. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the services will cease immediately. You may also terminate your account at any time through your account settings. All provisions of these Terms which by their nature should survive termination shall survive.

9. Disclaimers

Our services are provided 'as is' and 'as available' without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy or completeness of any information provided through our services.

10. Limitation of Liability

To the maximum extent permitted by law, Archyl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use the services. In no event shall our total liability exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Archyl, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of France. You agree to submit to the personal jurisdiction of such courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated terms on this page and updating the 'Last updated' date. Your continued use of our services after such modifications constitutes your acceptance of the revised terms.
